The long-running judicial review of the order that introduced the requirement to pay fees in employment tribunals was dismissed by the Court of Appeal in England. The Scottish government recently announced its decision to abolish the requirement to pay fees in Scotland in the future. The author explores aspects of the right to a fair trial and access to justice which may be of assistance in any future consultation on access to justice in employment law cases.
